John Albert Gardner III received a very light sentence in 2000 after prosecutors ignored a a psychiatrist’s warning and suggestion of a stronger sentence.
Prosecutors noted John Gardner’s lack of criminal history, and tossed in the standard “wanted to spare the victim the trauma of testifying” card when seeking the five year prison term for the sexual assault of a 13 year old girl.
Chelsea King, 17, has been missing five days, her clothes have been found, and reports are coming in now that a body has been found in the search area.
John Albert Gardner was arrested in connection with Chelsea King’s disappearance on Sunday, February 28th, 2010.

John Albert Gardner III faced an eleven year maximum sentence under a plea agreement arranged a decade ago; however lenient prosecutors urged only six of those and the Judge complied.
Gardner plead guilty to assaulting a 13 year old girl. He served five years. A mere five years.
Prosecutor’s acknowledge in an eleven page memo that John Albert Gardner “never expressed one scintilla of remorse for his attack upon the victim.”
Dr. Matthew Carroll gave his opinion in the sentencing memo also, stating: “There is no known treatment for an individual that sexually assaults girls and does not admit to it in any way.”
This psychiatrist warned the powers that be that Gardner would re-offend. He pleaded for a 30 year prison term.
Now Chelsea King, 17, beloved daughter, honor student, athlete, friend to all, has gone missing and John Gardner is behind bars. It’s expected that he will be charged with rape and murder tomorrow morning, Wednesday, March 3rd, 2010.
A body was found just a few yards from where Chelsea’s shoe was found. The body was in a shallow grave and is assumed to be that of Chelsea King. The body was located shortly after 4:00pm, EST.
There is strong physical evidence tying this rape and murder to John Gardner; however, please remember that in our judicial system, he is innocent until proven guilty in a court of law. He is currently being held in solitary confinement, for his protection of course.
Police are also looking for a link between John Gardner and 14 year old, still missing Amber Dubois.

What a sad day in our country when a vibrant, bright and beautiful young woman can’t even jog in broad daylight. I won’t call this phenomena a war on women, as I often hear. I do however think it’s an undeclared war on society in general.
I sense change is coming. It’s just a shame that Chelsea King had to die before it is enacted. Our children are priceless and precious; it’s time we showed these murdering rapists that we are not tolerating this anymore.
We offer our heartfelt sympathy to Chelsea King’s family and loved ones.

I have so many questions. Why were these warnings about this psycho ignored and he let out — ESPECIALLY because he showed no remorse? A life full of promise is now gone forever, because of that.
Why was he given such a short parole and his GPS taken off in 2008 when it ended? Why was information not posted on that jogging path/in the media about the attack on the other girl? If it had been, Chelsea King might still be with us; if women and girls knew there was a nutcase lurking there, they probably would not jog there.
This reminds me of the Chandra Levy case; the man they believed killed her, had previously attacked other women in the same area.
And finally, why were these extensive search tactics not used a year ago to try to locate Amber Dubois? I so hope the authorities can find out what happened to her.

Often times, because MENNNNN run our judicial systems and don’t see the severity of the issues, these monsters are let out of jail early. and what happens? They get on the street and start doing it again.
So this asshole, he got out when? in 2005? So this means that for 5 years he could have done numerous things to other girls, and this time he got caught.
These men cannot be rehabilitated, and you cannot just throw them back on the streets, yet it happens everyday.
There needs to be a complete overhaul on the judicial system. Absolutely ridiculous.

It is a DANGEROUS world, no female should be alone EVER. Daylight, especially at night. People have to WAKE UP. There is so much perversion in this world and men just drink it up. Yes, there are those very lost women that participate in the world of triple x movies doing major damage to us all. If I had a daughter, I would be her shadow, seriously. I have two boys and I talk about this issue regularly so they don’t believe adults, especially men, have it all together and are to be trusted. I am very sorry for the pain Chelsea had to endure, and the pain that her family now faces. I frankly don’t understand why a young girl wouldn’t be strongly discouraged, or forbidden, from jogging alone on a wooded path. The very idea gives me the chills in this world full of heartless people. Young people are idealistic and carefree, they don’t always think about consequences, so they need adults to persuade them away from activities that look innocent but can be a terrible trap.

Living here in Washington State whenever I see the word “Plea Deal” in a story like this I see red. And that is what I just read about this guy. Should have been in prison 30, but only got 6. One thing we can learn from China is tough on crime. Since we are unwilling to pay to lock them up forever, because our criminal system is not self-sustaining, we frequently let them out early, for the sake of our pocketbook, and they can’t find work because of their criminal history, they frequently commit another crime so as to be sent back for food and shelter. If we would make prisoner build something, like the Great Wall, we would benefit from their labor and don’t have to let them out early.

I am just so mad. Chelsea was 17. I have a seventeen year old daughter and right now she is waiting to hear from colleges about acceptance. I have just been thinking about the Kings opening their mailbox and having to face what was supposed to be. Kids work so hard at this time in their lives to “make it”. I am so angry that this loser of a person stole the gift of Chelsea from her family and all of the people that would have been touched by her gifts. We all lose.

I have to agree with Kim, you need to train your kids to always go with company to the park and mall and even to their part time jobs and back. They should have a careful strategy for coming back from their jobs at night. You shouldn’t leave children unattended in the yard ever, you have to be out with them. You should meet all the parents and siblings of their friends they spend anytime with. The second you hear of some uncle or older son still living at home under strange circumstances you should bail. you should give them a preporgrammed cellphone too. But there is no substitue for being with them.
go in groups, always. And insist their living arrangements away from home make sense. Never let a young woman jog alone frankly. Don’t trust you backyard, be in it. Build yourself a little covered area out there where you can do your mail and internet work and answer phones and really be present. I am not sure how you can rely on one psychiatrists report to judge somebody for life, but it sounds that they didn’t handle this case right to start with. Children need to be taught more ethics at a very early age in both public and church schools so they have a basis for behaving besides just satisfying thier impulses.

His family is probably in shock and disbelief that he is being accused of this. Back in 2000, that girl accused him of rape, then turned around and confessed to lying about it, but he still had to do the 6 years. Yes, they have physical evidence, but if you people really care about others the way your saying you do, then don’t act the immature kids saying “kill the ass for doing this.” And accept the fact that its happening this way. Everything happens for a reason, even if its uncertain.

The fact that the court previously allowed Gardner to get by with such a light sentence (5 years after pleading guilty to sexual assault charges) demonstrate a stark shortcoming in the way crime is punished in our judicial system. What can be accomplished with this short prison sentence for such a grave offense? It is a laugh if the court thinks that a mere 5 years of imprisonment will provide enough cause as to deter Gardner from reoffending.
It’s said that Gardner “never expressed one scintilla of remorse for his attack upon the victim.” Even in the case of rehabilitation, sex offenders such as Gardner who display no value for other human lives, the hopes of rehabilitative measures prove unlikely, if not altogether unviable. Clearly, if Gardner is not willing to display remorse for his actions or even admit guilt for his offenses, what’s to say that he won’t decide to reoffend after serving his 5 years? And that is exactly what happened in the tragic event with Chelsea King. Despite telltale signs that Gardner would likely, without thought, reoffend, he was still nonetheless allowed to get away too lightly and too easily.
And with the current love/hate relationship our state has with the death penalty, hopes for imposing death sentence and subsequent execution becomes a long and tedious legal process. This situation is then exacerbated by the heavy expense on behalf of the state and taxpayers. In Gardner’s case, preventative measures should have been taken. The fault, as mentioned before, was allowing Gardner to get away too easily, which is especially grave considering his risk for reoffending. In this light, Gardner should have been imprisoned for a much, much longer duration. Incapacitation is the key in a case such as Gardner’s. While a costly option (although substantially cheaper than death sentence—due to its long legal process), incapacitation becomes much more effective when it comes to keeping sex offenders such as Gardner off our streets.

I am the mother of two girls. The aunt to two others. And know many young women. What can we as a society do to get law makers attention that there is a serious need for stricter laws, enforced monitoring of sex offenders? I have thought about writing my Senator, Congress, whoever might be able to get the ball rolling for stricter sentencing. I have also wondered, outloud, why we can’t put a chip into an offender after the first offense? I believe that knowing they are being tracked might make them re-think an attack, realize that they will NOT get away with murder. Has this procedure been brought to anyone’s attention, can it be done? Please tell me who we should write to or call to begin the process of changing laws.

Chelsea had been cautioned by her high school running coach and her parents against running anywhere alone. However, you can’t hold a teenager’s hand through everything. She also should not have been afraid of running in a park in broad daylight. Next thing you know someone is going to be attacked just taking a walk down their driveway and someone else is going to say “That person should have been more careful.” It is absolutely ludicrous that anyone could suggest the victim in such situations has even a modicum of fault.
I am so sad for Chelsea King and her family. She had a great future ahead of her; she wanted to change the world. And you know what? Even though she won’t be here to see it, I think she already has.

I own a small auto repair business and my 2 best techs are convicted child molesters. Both of them have been great employees for over 10 years. These guys were convicted of rape of a child under the age of 12. They served their time and now they are productive members of society and nice guys to boot. One of them has told me that he still fantasizes about little girls while masterbating. That’s ok as long as it’s a fantasy and he doesn’t act on it. Here’s honestly what I’m wondering: was the 2000 offense, when he was age 20, a case of statutory rape or molestation, or did it involve violence? Was it a 20 year old hitting on a post puberty female and thus breaking the law, or something more fundamental and serious? I am concerned that an easy target (sex offender) has been assigned this crime in the desire to identify an offender, but did the previous crime have a level of violence to suggest murder? It would not be a good thing to put this guy to death if the real killer walks free, ya know?

well our form of criminal justice still has to protect the rights of the accused, predator or not, to try to make sure due process is carried out over all. Remember these are predators, not regular people so they will seem to get an unfair advantage at times. that is what they do. But to retain freedom for the rest of us we need to carefully follow proper procedures of prosecution and defense. I do think more effort should be put in accessing one’s probabiity of re-offending before release rather than just slapping everyone in giant public registries and give the public the job of figuring it out. Perhaps develop a numerical score for the parole board and prison officials to work from, rather than one counselors lone opinion which would be easy to discard or accept for reasons of convenience.

I hope you are right JoAnne. Here in WA State we have a special state run commitment center for dangerous sex offenders, even after they have served their sentence. The most notable resident is Kevin Coe, The South Hill Rapist, out of Spokane. I was surprised when I heard that he was not going to be let out of prison and was sent to this facility. Finally, a decision made to protect the general population and here no less. Brian, I agree with your assessment. Sadly these types of hideous crimes evoke such rage in people that extreme measures seem called for, even at the expense of “rights” of the accused.

@John—When little Jessica was kidnapped and buried alive, I think we all felt a sense of ‘something is about to change’—and it did.
Sadly, this is another of those times. Sounds like Washington might have the right idea—

I still don’t get why adults are doing this to children at all. really, what on earth? don’t they know they have crossed incredible boundries to damnation and don’t have any empathic reflexes at all? How totally alien.

I know the family of Amber Dubois and this tragedy had changed each of there lives tremendously, my prayer’s are with them. And if this bastard is responsible may he suffer the worst consequence possible. R.I.P. AMBER

I promise to only bring this up once because I know how sensitive people are about religion, but the Bible says “we are like sheep for slaughter”. What we see daily on this earth, is in my estimation, powers of darkness hell bent to destroy humanity.
What better way to prove this than a man or woman full of bitterness and evil taking their hate out on a defenseless child. It happens dozens of times everyday in this country.
Personally if I did not have the hope that Jesus promises I would never be able to grasp the horror that John Albert Gardner the III meted out on Chelsea King.

The fact of the matter is this is not going to be stopped with tougher laws. These guys have such a strong impulse to do this that no law is strong enough to stop them. If people want this to stop or slow down, there is a way to do it. It’s called “prevention.” John Albert Gardner is a lost cause. He probably hit the point of no return many years ago. The time to intervene is when people like this are young and there is time to stop it before these guys become monsters. The break down of the family unit is contributing tot this and the fact that our society discourages any type of moral training in the formative years. Kids are not taught appropriate moral behavior. Instead they are taught that mom and dad are bored with each other and got divorced. Kids entertain themselves with games like ” Grand theft auto,” and games far more disgusting, and we all wonder why people turn out the way they do. If we want to stop this, it starts early and with the parents. Shame on the person who made the comemnt, “didn’t anyone tell her that jogging alone is not smart?” As if it is the victim’s fault.

Just saw the movie called “Law Abiding Citizen”. Very fit for this topic. The murdered girl’s father essentially captures and dissects the murderer alive….pieace by piece allowing him to feel every moment of it. Loved it. Good movie.
